Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is part of and incorporated into our Terms of Service. It applies to everyone who uses GangNest, including Merchants and End Customers, and to all User Content you upload, create, nest, render, print, or sell. You are fully responsible for your content and conduct.

1.Prohibited content

You must not upload, create, nest, render, or produce any content that:

  • infringes or misappropriates any copyright, trademark, trade dress, patent, trade secret, right of publicity, moral right, or other intellectual-property or proprietary right, or is counterfeit;
  • you do not own or have all necessary rights, licenses, and permissions to use (including licensed characters, team or league marks, brand logos, fonts, and stock imagery);
  • is unlawful, fraudulent, deceptive, defamatory, libelous, or trade-disparaging;
  • is hateful or promotes violence or discrimination against people based on race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation, age, or other protected characteristic;
  • depicts or promotes the sexual exploitation or abuse of minors, or is otherwise child sexual abuse material (CSAM) — such content will be reported to authorities;
  • is obscene, pornographic, or harmful to minors;
  • promotes terrorism, violent extremism, self-harm, illegal drugs, illegal weapons, or other illegal goods or activities;
  • discloses another person’s private or personal information without authorization, or violates their privacy;
  • contains malware, viruses, or any harmful code; or
  • violates any applicable law or regulation, or the rules of Shopify or any payment provider.

2.Prohibited conduct

You must not:

  • use the Service to infringe anyone’s rights or to produce or sell infringing or counterfeit goods;
  • impersonate any person or entity or misrepresent your affiliation;
  • interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, accounts, systems, or networks;
  • probe, scan, or test the vulnerability of the Service, or breach security or authentication;
  • scrape, crawl, harvest, or use bots or automated means except as expressly permitted;
  • reverse engineer, decompile, copy, resell, sublicense, or create derivative works of the Service except as permitted by law;
  • circumvent or disable any fee, usage limit, security, or access control;
  • introduce malware or use the Service to transmit unsolicited communications; or
  • use the Service in violation of any export-control or sanctions law.

3.Products & printing

GangNest is a tool for arranging and producing your own lawful artwork. You are solely responsible for ensuring that anything you nest, print, or sell is lawful and properly licensed. Do not use the Service to produce counterfeit merchandise or items that infringe another party’s brand, character, athlete, team, or other rights, or that are restricted or prohibited where you operate.

4.Your responsibility

You are solely responsible for your User Content and conduct and for any consequences, including claims by rights holders or third parties. We do not pre-screen content, do not endorse it, and are not responsible for it. Under the Terms, you indemnify us against claims arising from your content and use.

5.Enforcement

We may, at our sole discretion and without notice or liability, investigate suspected violations, remove or disable content, refuse service, throttle, suspend, or terminate access, and report violations to Shopify, rights holders, or law enforcement. We may comply with legal process and cooperate with investigations. Our failure to act on any violation does not waive our right to act on it or any other.
